Using RollTrackApp means you agree to these Terms. Effective date: October 12, 2026.
1. Agreement and Definitions
These Terms and Conditions ("Terms") are a binding agreement between you and RollTrackApp, Inc., a Delaware corporation ("RollTrackApp," "we," "us"). They govern your access to and use of the RollTrackApp website, web application, and related services (the "Service"). By creating an account, signing in, or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
- Gym Owner: a person or business that signs up for RollTrackApp to manage a gym, academy, or similar business.
- Member: a student, athlete, or other individual whose profile a Gym Owner creates or who registers with a Gym Owner through RollTrackApp.
- Minor: a Member under 18 years of age.
- Gym Data: information that Gym Owners or Members enter into or generate through the Service, including profiles, attendance, membership plans, payment records, and signed documents.
- Authorized User: a staff member or coach that a Gym Owner permits to use the Service.
- Agreement: the order form, email, or other written confirmation in which RollTrackApp and a Gym Owner set the trial, price, and cancellation terms for that Gym Owner.
2. Eligibility
You must be at least 18 years old to create a Gym Owner account. Minors may have a profile only if a parent or legal guardian registers them or consents on their behalf. See Section 6A. You confirm that you have authority to bind any business you register. You may not use the Service if you are barred from doing so under applicable law.
3. Changes to the Service and to These Terms
RollTrackApp is an evolving product. We may add, change, or remove features, including features that are announced but not yet live. Features labeled beta or early access are provided as-is, may contain bugs, and may change or be withdrawn, and we do not promise that any feature will launch. We provide support by email, and we do not guarantee uptime or response times.
We may update these Terms from time to time. For material changes, we will give notice by email or in the Service at least 30 days before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
4. Accounts and Security
You must give accurate, current information when you register and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at the contact address in Section 20 if you suspect unauthorized access. We may require email verification and other checks before activating an account.
5. Gym Owner Responsibilities
Gym Owners run their own businesses, and RollTrackApp is a software provider only. We do not operate, supervise, or control any gym, class, or training activity. As a Gym Owner, you are solely responsible for:
- Your members, staff, classes, facilities, safety practices, and insurance.
- Your own membership terms, pricing, refund policy, cancellation policy, and liability waivers.
- Having the legal right and any required consent to enter Members' information into the Service, including consent from a parent or guardian for Minors.
- Your Authorized Users' compliance with these Terms.
- Complying with the laws that apply to your business, including consumer protection, automatic renewal, tax, privacy, and anti-spam laws.
6. Member Responsibilities
Members use the Service to register with a gym, sign documents, view membership information, and pay fees. A Member's relationship with a gym is a direct relationship with that gym, not with RollTrackApp. Members agree to provide accurate information and to use only their own profile. Questions about a gym's classes, fees, or policies go to the gym.
6A. Minors and Parent or Guardian Responsibility
Many gyms teach children and teens. These rules apply whenever a Member is a Minor.
- Gym Owner and Authorized User accounts are for adults only.
- A parent or legal guardian must register a Minor, or consent to the gym doing so. By doing this, the parent or guardian accepts these Terms for the Minor and is responsible for the Minor's use of the Service and for any fees.
- We do not offer accounts directly to children under 13. A gym may create a profile for a child under 13 only with verifiable consent from the child's parent or guardian, who is the account contact.
- Before a Minor's profile is created or completed, the Service asks the person entering it to confirm that parental or guardian consent has been obtained, and records that confirmation.
- Gym Owners represent and warrant that they have a reliable way to confirm parental or guardian authorization before entering a Minor's information, that they verify the identity and authority of the parent or guardian, and that they keep accurate records of every consent obtained. RollTrackApp may ask for proof of consent.
- Waivers and other documents for a Minor must be signed by a parent or legal guardian, not the Minor. Gym Owners are responsible for setting this up correctly and for checking who signed.
- Payment methods must belong to an adult. A Minor may not add or manage a payment method.
- Gym Owners may not use the Service to send marketing messages directly to a Minor. Send them to the parent or guardian.
- RollTrackApp does not independently verify anyone's age, identity, or authority to act for a Minor. Gym Owners are responsible for doing so and for keeping records of consent.
- A parent or guardian may ask the gym, or us, to review, correct, or delete a Minor's information, as described in our Privacy Policy.
- If we learn that a Minor's information was entered without required consent, we may remove it or suspend the profile until consent is given.
7. Free Trial, Subscription, and Fees
- Free trial: New Gym Owners may receive a free trial. Whether a trial applies, how long it lasts, and any conditions are set in your Agreement with us. No payment card is required to start a trial. When the trial ends, continued use requires a paid subscription.
- Price: Your subscription price is the price confirmed in your Agreement. Unless the Agreement says otherwise, subscriptions are billed monthly in advance and renew automatically until cancelled.
- Price changes: We will give at least 30 days' notice before changing your subscription price. The new price applies at your next renewal after the notice period.
- Early-partner or custom pricing: Any special rate applies only if we confirmed it in writing, and may end with notice.
- Taxes: Fees exclude applicable taxes, which you are responsible for.
- Cancellation: Cancellation terms, including any notice period, are set in your Agreement. Unless the Agreement says otherwise, you may cancel by emailing us at the address in Section 20, and cancellation takes effect at the end of the current billing period.
- Refunds: Subscription fees are non-refundable except where required by law or where we agree otherwise in writing.
- Failed payments: If a payment fails, we may retry it, suspend access after reasonable notice, and restrict features until the balance is paid.
8. Payment Processing Between Gyms and Members
RollTrackApp lets Gym Owners collect membership fees from Members. Payments are processed by Stripe, Inc. through Stripe Connect. Gym Owners must complete Stripe's onboarding and accept Stripe's terms, including the Stripe Connected Account Agreement. RollTrackApp does not hold Member funds, is not a bank or money transmitter, and is not a party to the payment between a Gym Owner and a Member.
- Gym Owners set their own plans, prices, billing dates, pauses, and cancellations, and are responsible for them.
- Payment disputes, chargebacks, refunds, and processor fees between a Member and a Gym Owner are the Gym Owner's responsibility.
- Members who pay by cash or other offline methods must be recorded accurately by the Gym Owner.
- Stripe's own terms and privacy policy apply to payment data. RollTrackApp does not store full card numbers.
- We may suspend payment features if Stripe restricts an account or if we suspect fraud.
9. Waivers and Electronic Signatures
The Service lets Gym Owners send waivers and other documents for electronic signature. Gym Owners provide and are responsible for the content of those documents. RollTrackApp does not draft, review, or give legal advice on them, and we make no promise that any waiver is enforceable in your jurisdiction. You and your Members agree that electronic signatures collected through the Service have the same effect as handwritten ones to the extent the law allows.
10. Communications
By using the Service you consent to receive transactional messages from us and from your gym, such as verification codes, receipts, billing notices, and account alerts. Gym Owners may use the Service to send marketing or promotional email to their own Members. Gym Owners are solely responsible for having consent, honoring opt-outs, and complying with the CAN-SPAM Act, TCPA, and similar laws. Members may unsubscribe from marketing messages at any time using the link in the message. We may send Gym Owners product updates and service notices.
11. Your Data and Privacy
- Ownership: Gym Owners keep ownership of their Gym Data. You give RollTrackApp a limited license to host, process, display, and transmit Gym Data only to provide, secure, and improve the Service.
- Roles: For Member personal information, the Gym Owner decides why and how it is used, and RollTrackApp processes it on the Gym Owner's behalf. Our Privacy Policy explains what we collect and how we use it.
- Minors' data: Gym Owners must get parental or guardian consent before entering a Minor's information. See Section 6A.
- Aggregated data: We may use de-identified and aggregated data to improve the Service and publish general statistics. We will not identify you or your Members in them.
- Export: Gym Owners may request an export of their Gym Data at any time while their account is active, and within 30 days after it ends. We provide the export within 30 days of the request.
- Deletion: After an account ends and the 30-day request window has passed, we delete Gym Data within a reasonable period unless the law requires us to keep it.
- Security: We use reasonable administrative, technical, and physical safeguards. No system is perfectly secure, and we cannot guarantee absolute security.
- Sub-processors: We use vendors to run the Service, such as Stripe for payments and Resend for email delivery. They may process data only as needed to serve us. The current list is on our Sub-processors page.
12. Acceptable Use
You may not:
- Break the law or use the Service to harm, harass, or defraud anyone.
- Enter data you have no right to share, or collect payments for goods or services you do not provide.
- Probe, scan, or test the Service's security, or bypass access controls.
- Reverse engineer, copy, resell, or build a competing product from the Service, except as law allows.
- Upload malware, or overload or disrupt the Service.
- Use bots or scrapers to access the Service without our written permission.
- Send spam or unlawful messages through the Service.
- Enter Social Security numbers, government ID numbers, full card numbers, or medical records into the Service.
13. Intellectual Property and Feedback
RollTrackApp and its licensors own the Service, including software, design, text, logos, and the RollTrackApp name. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own gym operations while these Terms are in effect. We do not transfer any ownership to you. If you send us ideas or suggestions, you grant us a perpetual, royalty-free right to use them without owing you anything.
14. Third-Party Services
The Service connects to services we do not control, including Stripe and email providers. Those services have their own terms, and we are not responsible for them or for their outages. Your use of them is at your own risk.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, ROLLTRACKAPP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY FEATURE WILL BE AVAILABLE AT ANY PARTICULAR TIME. ROLLTRACKAPP DOES NOT PROVIDE LEGAL, TAX, MEDICAL, OR SAFETY ADVICE, AND IS NOT RESPONSIBLE FOR ANY INJURY OCCURRING AT OR IN CONNECTION WITH A GYM.
16. Limitation of Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, ROLLTRACKAPP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
17. Indemnification
Gym Owners will defend and indemnify RollTrackApp, its officers, employees, and agents against claims, losses, and expenses, including reasonable attorneys' fees, arising from the Gym Owner's business, Gym Data, waivers, member injuries, misuse of the Service, entry of a Minor's information without required consent, or breach of these Terms.
18. Suspension and Termination
You may stop using the Service and close your account at any time, subject to the cancellation terms in Section 7 and your Agreement. We may suspend or end your access immediately if you breach these Terms, create risk or legal exposure for us, fail to pay, or if we stop offering the Service. We will give reasonable notice where practical. If a Gym Owner's account ends, the Gym Owner is responsible for telling Members and for ending or moving their memberships and recurring payments, and we may stop recurring billing set up through the Service. On termination, your right to use the Service ends, the data provisions in Section 11 apply, and sections that by nature should survive will survive, including 13, 15, 16, 17, and 19.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. Before filing a claim, each party will try to resolve the dispute informally by written notice and 30 days of good-faith discussion. Disputes not resolved informally will be decided by the state or federal courts located in the State of Delaware, and each party consents to the personal jurisdiction of those courts. You waive any right to a jury trial and to bring or join a class action to the extent the law allows.
20. General and Contact
These Terms, with our Privacy Policy and your Agreement, are the entire agreement between us on this subject. If a provision is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in a merger or sale. Neither party is liable for delays caused by events beyond its reasonable control.
